Bordeaux Point RV Park

This rental agreement is made on the ___ day of _______, ____ between, Bordeaux Point RV Park, with it’s principal offices located at 1000 Loggerhead Lane on Tunica Lake in Tunica MS,  38676 referred to herein as Leessor, and (Lessee/Guest) referred to herein as Lessee.

Lessor leases to Lessee, and Lessee leases from Lessor, for the term of this agreement, RV spot # _______ of the Bordeaux Point RV Park and being hereafter referred to as RV spot (whether one or more), and pursuant to the following terms and conditions;

1. Rent: Lessee agrees to pay as rent $_________/ monthly for RV Spot(s) beginning _______________, 20__ through______________, ______ and to run consecutively month to month under this agreement until it is disrupted, or Lessee is notified.  Payable without demand, either by Cash or Check on the 3^rd of each month.  This agreement is not a lease but an agreement to rent said property.

2. Utilities/Cleaning:  Lessee shall pay for all utilities and other utilities supplied.  Also weed eating and policing lot area for trash and sticks.

3. Assignment and Subleasing: Lessee shall not sublet the RV spot, or any part of the premises, or assign this agreement without Lessor’s prior written consent.

4. Default: Any failure by lessee to9 pay rent or other charges promptly when due or to comply with any other terms & conditions of this agreement shall, at Lessor option, promptly terminate this tenancy and forfeit all rights of Lessee under this agreement.

5. Maintenance and redelivery of RV Spot: Lessee shall keep or maintain the RV Spot in a clean and sanitary condition as when received, ordinary wear and tear and damage by elements excepted.

6. Effect of holding over: The parties agree that any holding over by lessee under this agreement, without Lessor’s written consent, shall be terminated at will which may be terminated by lessor in accordance with applicable laws.

7. Indemnification: Lessee shall indemnify, defend, and hold Lessor harmless of any and all claims damages (including reasonable attorney fees and costs) arising from Lessee’s use of the RV Spot or from any activity permitted by Lessee in or about the RV Spot unless caused by the negligence or willful misconduct of Lessor.  Lessee shall further indemnify, defend, and hold Lessor harmless from any and all claims and damages (including reasonable attorney fees and costs) arising from any breach order fault in the terms of this agreement, or arising from any act , negligence, fault or omission of Lessee, and from any and all costs, reasonable attorney’s fee, expenses, and liabilities incurred on or any action or proceeding brought on such claims.  In case any action of proceeding shall be brought against Lessor by reason of any such claims, Lessee’s expense by counsel approved in written by Lessor.

8. Mandatory Arbitration: Any dispute under this agreement shall be required to be resolved by binding arbitration of the parties hereto.  Each paying half in advance of projected cost held by Lessor.  If the parties cannot agree on an arbitrator, one will be selected buy local Justice of the Peace.  The arbitration shall be governed by the rules of the American Arbitration Association thin in force and effected.

9. Governing Laws: This agreement shall be governed by, construed and enforced in accordance with the laws of the State of Mississippi.

10. Waivers: Waiver by Lessor of any breach of any covenant or duty of Lessee under this agreement is not a waiver of a breach of any other covenant or duty of the Lessee, or of any subsequent of same covenant or duty.

11. Counterparts: This agreement is executed in multiple counterparts, all counterparts taken together constitute this agreement.  Copies of signatures to this agreement are effected as an original of signatures.
